A claim for judicial separation due to discord and dispute is one of the most common cases in personal status courts, especially when marital life becomes impossible to continue.

When discord is proven and the appointed arbitrators determine the percentage of fault between the spouses, an important question arises:

How are the wife’s financial rights (mahr/dowry) calculated?

This article explains the calculation method in accordance with Article (126) of the Personal Status Law, supported by a practical example.


What Is Judicial Separation for Discord and Dispute?

Judicial separation for discord and dispute is the dissolution of a marriage by court judgment when serious and irreconcilable conflict between the spouses is established. The court appoints two arbitrators to assess the situation and determine each party’s percentage of fault.

How Are the Wife’s Financial Rights Calculated?

Once the arbitrators determine the percentage of fault, the wife’s entitlement from the dowry is calculated based on the husband’s percentage of responsibility for the discord.

Practical Example

1️⃣ Dowry Details in the Marriage Contract

  • 2,000 JOD – Immediate dowry (paid)
  • 2,000 JOD – Dowry supplements
  • 2,000 JOD – Deferred dowry
  • Total dowry = 6,000 JOD

2️⃣ Percentage of Fault Determined by Arbitrators

  • Wife’s responsibility: 40%
  • Husband’s responsibility: 60%

3️⃣ Calculation Method

Step 1: Calculate the total dowry 2,000 + 2,000 + 2,000 = 6,000 JOD

Step 2: Multiply the total dowry by the husband’s fault percentage 60% × 6,000 = 3,600 JOD

Step 3: Deduct the immediate dowry already received by the wife (example: 2,000 JOD) 3,600 – 2,000 = 1,600 JOD

Therefore, the wife is entitled to 1,600 JOD.


Legal Principle

According to Article (126) of the Personal Status Law:

If fault is attributed to both spouses, separation is determined proportionally, and the wife is entitled to her dowry in proportion to the husband’s percentage of fault.

This means the wife does not automatically receive the full dowry if she bears partial responsibility for the dispute. She is only entitled to the portion corresponding to the husband’s share of fault.


Important Notes

  • If the husband is 100% at fault, the wife is entitled to the full dowry.
  • If the wife is 100% at fault, she may not be entitled to the dowry.
  • The arbitrators’ report is the primary basis for determining fault percentages.
  • Court discretion and case-specific circumstances may affect the final judgment.
