What Does “Nushooz” Mean?
The Arabic word “Nushooz” originally means rising or elevating. In this context, it describes a wife who “rises above” her husband’s authority and refuses the marital duties that Islam has prescribed.
In Islamic teachings, a disobedient wife (Nashiz) is one who goes against her husband in matters where obedience is religiously required, such as:
- Refusing to live with him in the marital home without a valid reason,
- Leaving the house without his permission,
- Refusing marital relations without an excuse,
- Or rejecting to move with him to an appropriate residence.
In such cases, the wife is considered Nashiz (disobedient), and therefore loses her right to financial support (nafaqah) — unless she is pregnant, in which case the support continues for the pregnancy.
Nushooz in Jordanian Personal Status Law
According to Article 62 of the Jordanian Personal Status Law:
“If the wife is disobedient (Nashiz), she is not entitled to financial support unless she is pregnant, in which case support is for the pregnancy. A disobedient wife is one who leaves the marital home without a legitimate reason or prevents her husband from entering her home before requesting relocation to another residence. Legitimate reasons for leaving include the husband’s abuse, mistreatment, or failure to ensure her safety or property.”
In simple terms, not every case of a wife leaving home counts as disobedience. If the husband abuses, insults, or mistreats her, the wife has the right to protect herself and leave — and she is not considered disobedient in such situations.
In Summary
“Nushooz” doesn’t mean rebellion without reason — it means refusing rightful obedience within a lawful marriage. But if a wife is being harmed or mistreated, Islam and Jordanian law protect her rights and do not consider her disobedient.
In all cases, open communication, respect, and mutual understanding between spouses are the best ways to prevent marital conflict and avoid reaching the stage of nushooz.
