Khula is one of the legal means for a wife to end a marriage at her request. The Personal Status Law regulates its forms and conditions to balance the rights of both spouses. Khula is divided into two main types: consensual (agreed) Khula and judicial Khula, each with different rules and effects.
First: What Is Consensual (Agreed) Khula?
Consensual Khula occurs when both spouses agree voluntarily to end the marriage, in exchange for a financial compensation or the wife’s waiver of some or all of her financial rights.
This type is also called:
“Divorce in exchange for release”
Forms of Consensual Khula:
- The wife agrees to pay a certain amount to the husband
- The wife waives part of her financial rights
- The wife waives all her financial rights, according to mutual agreement
Example:
If the wife’s dowry (mahr) is 6,000 dinars, the spouses may agree that:
- The wife pays only 3,000 dinars
- Or she waives the full dowry
- Or any other mutually agreed arrangement
📌 Note: In consensual Khula, the court does not intervene to determine the compensation, as long as the agreement is voluntary.
Second: What Is Judicial Khula?
Judicial Khula is also known as:
“Separation by redemption”
It is a court proceeding filed by the wife when an agreement with the husband on consensual Khula cannot be reached.
Cases of Judicial Khula:
1. Judicial Khula Before Consummation
If Khula occurs before consummation, the wife redeems herself by:
- Returning what she received from the husband
- Returning any gifts or expenses the husband incurred for her
2. Judicial Khula After Consummation
If Khula occurs after consummation, the wife redeems herself by:
- Returning only the dowry she received
- If she has not received the dowry, she redeems herself by waiving her right to it
📌 In this case, the wife is not required to return expenses incurred on her after marriage.
