Either spouse has the right to request separation for discord and dispute if they claim to have suffered harm from the other spouse that makes continuation of marital life impossible, whether the harm is material, such as physical or verbal abuse, or moral.
Moral harm includes any disgraceful conduct or behavior contrary to good morals that causes moral offense to the other spouse.
It also includes the persistence of the other spouse in violating marital duties and rights referred to in Chapter Three of Part Three of this Law.
